Agreement to Terms
These Terms of Service constitute a legally binding agreement between you and Thrive Santa Monica Tree Service regarding your use of our services. By engaging our services, you agree to be bound by these terms. If you do not agree with these terms, please do not use our services.
Services Provided
Thrive Santa Monica Tree Service provides professional tree care services including but not limited to tree removal, tree trimming and pruning, stump grinding and removal, emergency tree services, land and lot clearing, tree health and maintenance, arborist consulting, and shrub and hedge trimming. All services are performed by trained professionals using industry-standard equipment and techniques.
Estimates and Pricing
We provide free estimates for our services. Estimates are based on visual inspection and information provided by the client. Final pricing may vary if conditions differ from those observed during the estimate. We will notify you of any significant price changes before proceeding with work. Payment is due upon completion of services unless other arrangements have been made in writing.
Client Responsibilities
Clients are responsible for obtaining any necessary permits required for tree work on their property. Clients must provide accurate information about property boundaries, underground utilities, and any site conditions that may affect our work. Clients must ensure that our crew has clear access to work areas and that pets are secured during service. Any damage to underground utilities, sprinkler systems, or other features not disclosed to us prior to work is the client's responsibility.
Liability and Insurance
Thrive Santa Monica Tree Service carries comprehensive liability insurance and workers compensation coverage. We are not responsible for damage to underground utilities, sprinkler systems, or other features that were not disclosed to us prior to beginning work. We are not liable for damage caused by hidden defects in trees or unforeseen conditions that could not be detected during normal inspection. Our liability is limited to the amount paid for services rendered.
Cancellation Policy
Clients may cancel scheduled services with at least 24 hours notice without penalty. Cancellations with less than 24 hours notice may be subject to a cancellation fee. We reserve the right to cancel or reschedule services due to weather conditions, equipment failure, or other circumstances beyond our control. In such cases, we will make every effort to reschedule at the earliest convenient time.
Warranty and Guarantees
We guarantee that all work will be performed in a professional manner using industry-standard practices. However, we cannot guarantee the survival or future health of trees, as many factors beyond our control affect tree health. We do not warrant that trees will not fail or cause damage in the future, as tree condition can change over time. Any warranties or guarantees must be provided in writing and are limited to the specific services described.
Dispute Resolution
Any disputes arising from our services will first be addressed through good faith negotiation. If a resolution cannot be reached, disputes will be resolved through binding arbitration in Santa Monica, California, in accordance with the rules of the American Arbitration Association. Each party will bear their own costs and attorney fees.
Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms. We encourage you to review these terms periodically.
